2022 guidelines for applying for judicial certification in Vietnam (No.1 and No.2)

What is a judicial certification?

A judicial certification (criminal record certificate) is a card showing an individual’s criminal record and is issued by the institution that manages the judicial record database (the Ministry of Justice or the national criminal record center under the Ministry of Justice).

Judicial certification: Prove whether the applicant is prohibited or isn’t prohibited whether the establishment, management, or position of individuals in enterprises or cooperatives (for those enterprises and cooperatives declared bankrupt by the court).

Judicial record certificate includes Judicial certification No.1 and Judicial certification No.2.

Judicial certification No.1: it shows the applicant’s existing criminal conviction and is issued to individuals, institutions, and organizations to serve human resource management and determine the right to establish and manage enterprises and contracts.

The documents to be prepared for applying for a Judicial certification No.1 include:

  • Application form for Judicial certification No.1;
  • Copy of the first page of the applicant’s ID card/passport;
  • Photocopy of the registered residence of the applicant or copy of the permanent/temporary residence certificate.

Judicial certification No.2: shows all criminal convictions and is issued to individuals to verify their criminal records or to procedure enforcement agencies to serve investigation and trial.

To apply for Judicial certification No.2, you need to prepare the following documents:

  • Application form for Judicial certification No.1;
  • Copy of the first page of the applicant’s ID card/passport;
  • Photocopy of the registered residence of the applicant or copy of the permanent/temporary residence certificate.

(1) Application processing time

10-15 days, depending on the institution accepting the application for judicial filing, apply for judicial filing according to the situation.

Place of application for Judicial certification

Ministry of justice, permanent/temporary residence:

  • Foreigners living in Vietnam;
  • Vietnamese citizens living abroad;
  • For Vietnamese citizens living in Vietnam (permanent/temporary residence address can be determined).

National criminal record center:

  • For foreigners who have lived in Vietnam and currently live abroad;
  • For Vietnamese citizens whose permanent/temporary residence address cannot be determined.

How to apply for Judicial certification online:

In addition to applying for a judicial certification in the form of direct submission, you can also apply online. We will gradually guide you on how to apply for a judicial certification online, as follows:

On the online criminal record registration page of the Ministry of Justice: https://lltptructuyen.moj.gov.vn/home?locale=en

  • Step 1: log in to “registration of Judicial certification issued online by the Ministry of justice”;
  • Step 2: select the applicant;
  • Step 3: choose permanent / temporary residence;
  • Step 4: after selecting the “> >” sign, you will be redirected to the online criminal record registration page according to your permanent/temporary residence (you selected in step 3).

On the online criminal record registration page of the Ministry of justice, permanent/temporary residence (e.g. Ho Chi Minh City Ministry of justice, Hanoi Ministry of justice, Da Nang Ministry of justice…)

  • Step 1: Click “start” on the home page;
  • Step 2: fill in all the details of the declaration form. When finished, click “next”;
  • Step 3: carefully check all the information you enter. If correct, click next. You can print and sign the declaration in this step;
  • Step 4: save the online code displayed on the screen; click “Finish” to finish;
  • Step 5: Please bring your personal data (reference here) and online code to the receiving department.

Note: after completing the online criminal record inquiry procedure, you must submit paper documents to the accepting institution.

(2) How can a foreign citizen apply for a Judicial certification

Personal submission – documents to be prepared: application form for criminal record certificate, copy of passport, copy of foreigner’s permanent/temporary residence certificate.

You submit your application to the Ministry of justice, residence (foreigners living in Vietnam), or national criminal record center (foreigners living abroad).

(3) Services for process Judicial certification:

You only need to provide the following information:

Original ID card / CCCD and copy of household register (Vietnamese);

Visas and passports to Vietnam and copies of passports with my signature on them (foreigners / stateless persons).
