From February 15, 2021, the work permit just can only be extended once, and the maximum length of the work permit shall not exceed 2 years. In addition, Decree No.1152/2020/NĐ-CP also specifies the conditions, documents, and procedures for foreign workers to renew their work permits.

1/ Conditions for extension of work permit in Vietnam:

• The valid period of the work permit shall be at least 05 days, but not more than 45 days;
• Obtain approval from the competent authorities for the requirements of foreign workers;
• A document certifying that a foreign worker continues to work for the employer in accordance with the contents of the work permit issued.

2 / Documents required for extension of work permit in Vietnam:

• The written request for extension of employer’s work permit (using form 11/PLI);
• 02 color photos (4cm x 6cm, white background, straight face, no color glasses) within 06 months from the date of application;
• Valid work permit (5 days < validity < 45 days);
• Require the approval of foreign employees in writing, except that the use of foreign employees is not required;
• The certified copy of the passport is valid in accordance with the law;
• Health certificate;
• A document certifying that a foreign worker continues to work for the employer in accordance with the contents of the work permit issued.

Note: if the original document or certified copy is foreign, it must be legalized by the consulate and translated into Vietnamese, unless it is exempted from legalization by the consulate according to regulations.

3/ Procedure for extension of work permit in Vietnam:

Enterprises and organizations that guarantee the work of foreigners must implement the procedure of renewal of work permits.

• Step 1: the employer must submit a request for renewal of the work permit to the Ministry of Labour, Invalids, and Social Affairs at least 05 days in advance but not within 45 days before the expiry date of the work permit.
• Step 2: Within 05 working days from the date of receiving the full application for the extended work permit, the relevant competent authority shall extend the work permit. If there is no extension of the work permit, there will be a written reply to clarify the reasons.
• Step 3: for a foreign worker working under a labor contract, after giving the foreign worker an extended work permit, the employer and the foreign worker must sign a written labor contract in accordance with the Vietnamese labor law before the expected date of work in Vietnam.

The employer must send the signed labor contract to the competent authority extending the work permit as required. The labor contract is an original or certified copy.
